Judicial Impeachment -- The People's Remedy

Impeachment is the people's remedy for corrupt, biased or prejudiced judges who misapply laws and violate fundamental rights guaranteed in state and federal constitutions and who, thereby, inflict serious damage upon a citizen. It happens all the time, most commonly in the Star Chambers known as "family courts," where facts are what judges and the associated witch doctors say they are, and "rights" exist on another planet. It is these criminal vermin who must be removed from office and power. Impeachment is how we, the people, can do that.

Two judges who fit the profile of defilers of the Constitution and destroyers of children's and parents' lives are Cheryl L. Post and Juanita L. Rice of the Arapahoe County District Court of Colorado. We're going to give you a brief summary on how you can help get these corrupt judges -- tyrants in black pajamas -- off the bench.

First, some important background:

Article II of the Colorado Constitution, our Bill of Rights, states, in pertinent part:

Section 1. Vestment of political power. All political power is vested in and derived from the people; all government, of right, originates from the people, is founded upon their will only, and is instituted solely for the good of the whole.

Section 3. Inalienable rights. All persons have certain natural, essential and inalienable rights, among which may be reckoned the right of enjoying and defending their lives and liberties; of acquiring, possessing and protecting property; and of seeking and obtaining their safety and happiness.

Section 6. Equality of justice. Courts of justice shall be open to every person, and a speedy remedy afforded for every injury to person, property or character; and right and justice should be administered without sale, denial or delay. Section 25. Due process of law. No person shall be deprived of life, liberty or property, without due process of law.

Article XII of the Colorado Constitution states, in pertinent part:

Section 8. Oath of civil officers. Every civil officer, except members of the general assembly and such inferior officers as may be by law exempted, shall, before he enters upon the duties of his office, take and subscribe an oath or affirmation to support the constitution of the United States and of the state of Colorado, and to faithfully perform the duties of the office upon which he shall be about to enter.

Amendment XIV of the U.S. Constitution states, in pertinent part:

Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Article XIII of the Colorado Constitution states, in pertinent part:

Section 2. Who liable to impeachment judgment no bar to prosecution. The governor and other state and judicial officers, shall be liable to impeachment for high crimes or misdemeanors or malfeasance in office, but judgment in such cases shall only extend to removal from office and disqualification to hold any office of honor, trust or profit in the state. The party, whether convicted or acquitted, shall, nevertheless, be liable to prosecution, trial, judgment and punishment according to law.

Impeachment is a political process. It is instigated in the House of Representatives on somebody's request, either a legislator or a citizen. Article II, Section 24 of the Colorado Constitution declares that "The people have the right ... to apply to those invested with the powers of government for redress of grievances, by petition or remonstrance." Well, having your children stolen from you in a "family" court and having a judge violate his or her oath of office to uphold the state and federal constitutions -- such as so-called judges Cheryl Post and Juanita Rice did and continue to do -- are grievances worthy of redress.

The process is started by a citizen by filing a Petition with the state House requesting an investigation of allegations made in an accompanying sworn Affidavit. (To see an example of a real Petition and Affidavit which was filed and will be refiled this next session, click here.)

The Petition and Affidavit must allege judicial conduct which reaches the level of Constitutional violations of a litigant's rights in order to be taken seriously. Therefore, we have provided a page (see link below) where you can tell a brief version of your story for us to ensure that your case has the elements of an impeachable offense. Please use that page as the first step in getting this going. We'll contact you to help you move forward if your case has the necessary elements.

The Affidavit portion is essentially a bare-bones fact narrative, alleging, first, what you asked for, what the judge knew and how he or she ruled, and what the violation was. For example: "On such and so date in final orders hearing, I requested equal parenting time and parental responsibilities and rights with regard to my children. I have committed no offense which might forfeit for me the right to equal protection under the laws; the court was fully informed of that, and my ex-spouse presented no countervailing evidence to rebut my innocence of any offensive conduct. In spite of this, Judge Moron gave my ex-spouse all parental rights and responsibilities (decision-making), and full residential custodianship, and 'awarded' me every other weekend 'parenting' time and not even any overnight stays for the children. This violated my rights to due process and equal protection under both the Colorado and the Federal Constitutions."

It cannot be stressed enough that to get one of these tinpot tyrants off the bench, we need to work together and be many! If one person files a Petition, he or she is just an "angry person." If 30 or 50 or 100 or 300 people file Petitions alleging unconstitutional conduct by a "judge," WE are right and the JUDGE is wrong! And the judge is GONE!

We'll help you edit your affidavit to make it "work." The more people who join this "clean up the bench" effort, the more petitions we can get to get enough judges under the scrutiny of the House to get the attention of EVERYBODY who needs to know that THE CITIZENS OF COLORADO ARE MAD AS HELL AND AREN'T GOING TO TAKE IT ANYMORE!!!

Freedom from tyranny is not free! Only the PEOPLE can mobilize the PEOPLE to take back our liberty from the judicial tyrants who destroy our lives and our children everyday! Be part of this uprising of the people against their judicial oppressors!

To all the "judges" who think violating the constitutions you swore to uphold and violating the PEOPLE whose rights it is your duty to protect are "okay" in "family" court: START PACKING. YOUR DAYS ARE NUMBERED.
